1.1 The expression "online sales contract" means the purchase and sale contract relating to the tangible movable assets of City Tre Srl stipulated between them and the Buyer as part of a remote sales system using telematic tools, organized from City Tre Srl

2 the expression "Seller" refers to City Tre Srl with registered office in Milan (MI), viale Forlanini Enrico 23 Cap 20134, registered with the Milan Chamber of Commerce no. 2521046, VAT number No. 07422450721, part of this contract, which manages the Site, selling the products indicated below directly to users (Buyers);

3 the expression "Buyer" refers to the final consumer-customer who is authorized to operate on the Site in order to purchase the products, according to the methods indicated in these general conditions;

4 the expression "Products" refers exclusively to movable goods present in the electronic catalogs of the Site;

5, "Consumer" means the natural person who purchases goods for purposes that are not directly or indirectly related to any professional activity carried out.

6 the expression "Parties" refers to the Seller and the Buyer jointly understood;

7 the expression "Site" refers to the website corresponding to the address www.citymoda.it through which it is possible to make online purchases;

8 the term "Consideration" refers to the selling price of each product;

1 These general conditions, which are made available to the Buyer for reproduction and conservation in accordance with the law, have as their object the purchase of products, carried out remotely and via an electronic network, via the website belonging to the Seller , with headquarters in Modugno, SS 96 km 115.353 70026 Modugno (BA), VAT number 07422450721,

2 With this contract, respectively, the Seller sells and the Buyer purchases remotely the movable goods indicated below via telematic tools, indicated and offered for sale on the website www.citymoda.it

The goods and/or services covered by this contract are all the products chosen by the Buyer and placed in the virtual cart, following the online purchase procedures indicated on the site.

3 The products referred to in the previous point are illustrated on the web page www.citymoda.it

The contract between City Tre Srl. and the Buyer is concluded exclusively through the internet, by accessing the Buyer at the address www.citymoda.it where, following the procedures indicated, the Buyer will formalize the purchase of the goods, referred to in point 1 of the previous article.

1 These general conditions are valid from the day of conclusion of this contract and may be updated, integrated or modified at any time by the Seller, who will communicate it via the pages of the Website and such updates/modifications and/or additions will have effectiveness for future purchases.

2 The Buyer, by sending the confirmation of his purchase order electronically, unconditionally accepts and undertakes to observe, in his relations with the Seller, the general and payment conditions illustrated below, declaring that he has read and accepted all the indications provided by him pursuant to the regulations referred to above, also acknowledging that the Seller does not consider himself bound to different conditions unless previously agreed in writing.

3 The contract is not considered perfected and effective between the parties in the absence of what is indicated in the previous point.

1 The purchase can be made either with the normal registration procedure on the site and virtual payment or by telephone at the number indicated on the home page (080 968530 ) with consequent bank transfer or cash on delivery.

3 The accepted payment methods are shown in the following table.

CREDIT CARD

City Tre Srl accepts payment by credit card. The buyer does not necessarily have to correspond to the credit card holder, provided that the buyer has received express authorization to use the card. At the time of purchase, to avoid fraud, the buyer's and cardholder's data will be requested. City Tre Srl is not responsible if there is an improper or illicit use of this means of payment, as the sole responsibility of City Tre Srl is to authorize the purchase only when the card holder data entered at the time of payment corresponds effectively to those of the owner thereof. For "American Express" cards, the Buyer must necessarily correspond to the cardholder and the order may take longer than expected to be processed due to more in-depth checks.

PAYPAL

City Tre Srl accepts payment via Paypal. The order will be processed if and only if the Paypal account data matches the billing data of the order itself.

AMAZON PAY

City Tre Srl accepts payment via Amazon Pay. The order will be processed if and only if the Amazon Pay account information matches the billing information for the order itself.

BANK TRANSFER

City Tre Srl accepts payment by bank transfer. City Tre Srl reserves the burden of promptly communicating, after the purchase, the bank details which may already appear during the online completion of the payment. The order will be processed when the bank transfer is successful.

MARK ON DELIVERY

City Tre Srl accepts payment by cash on delivery. Cash on delivery has an additional fixed cost of €7.90. The payment method is valid only in Italy and cannot exceed an amount of €1,999.00.

SCALAPAY

City Tre Srl accepts payment via Afterpay. Payment allows you to immediately receive the purchased products and pay in 3 convenient equal installments expiring every 4 weeks. The service has no additional costs for the customer if the installments are paid by the due date. To proceed with the purchase, you must follow the procedure indicated and create an Afterpay account. At the time of purchase, the first installment will be charged immediately (equal to one third of the total value of the purchase). The next 2 installments will be charged every 4 weeks. The payment method is valid only in Italy and cannot exceed an amount of €600.00.

SATISPAY

Satispay is the mobile payment app with which to pay for your online purchases. From your cart you can also choose Satispay as a payment method. Check that the mobile number indicated in your profile is the same as the one associated with your Satispay account.
In the cart, once you have selected the Satispay payment method, click on CONFIRM AND PAY. You will send the payment request to the Satispay mobile app. Open the APP and confirm the payment request.

1 City Tre Srl will deliver the products selected and ordered, in the manner chosen by the Buyer or indicated on the website at the time of offering the goods, as confirmed in the e-mail referred to in point 4.2.

2 Shipping times may vary: they are indicative and not guaranteed (24/48 working hours). We will proceed with processing the order as soon as the payment is authorized (in case of payment by credit card, Paypal, Afterpay or Satispay) or as soon as the transfer amount is physically credited to our current account at our bank (in case of payment by bank transfer) and the items will be available, orders will be processed as quickly as possible. This verification may cause a delay in the shipment of your order.

3 Shipments are made via GLS courier. Shipping costs in Italy are free, except for different specifications. For orders whose amount is less than 80 EUR, shipping costs amount from a minimum of 5 euros to a maximum of 16 euros (the amount varies if the shipment is to be made to Venice, the Major and Minor Islands) . In EU countries, orders whose value in a single transaction exceeds 200 Euros are shipped free of charge. In non-EU countries, orders whose value in a single transaction exceeds 500 Euros are shipped free of charge, while the customer is always responsible for any local, import and/or customs clearance taxes. Unique cost of 50 Euros for each country (30 Euros only for Norway and 70 Euros only for Turkey). In countries belonging to the EU and in non-EU countries for orders lower than the amounts indicated, the cost of shipments including customs fees is €24.50

5 Return times are in working days and are to be considered indicative and not guaranteed.

6 If the expected weight for each expense is exceeded, a higher cost will be applied for each additional kg of goods. The costs, for weights greater than those reported, can be calculated by visiting the website www.ups.com for abroad and www.gls-italy.com for Italy.

7 In case of absence of the recipient, after three attempts, the GLS network will arrange collection at the nearest branch, where the Buyer can go to collect the shipment in question within 10 days. To find out all the Parcel Shop points, visit the website www.gls-italy.com

It is possible to make a purchase online and collect it for free in one of our five stores. It's very simple: just add the items to the cart and choose the most convenient store for collection. Once the order is ready, the customer will receive an email and will be contacted by the store chosen for collection. To collect it, from the date of telephone contact, the customer has 7 days at his disposal (excluding Saturday and Sunday). All you need to do is show the order confirmation received via email at the time of purchase and an identity document or any delegation at the checkout. In case of failure to collect the goods, the goods will be returned to our warehouses and the order will be cancelled.

The service is active only for orders with digital payment (Credit Card, Paypal, Amazon Pay, Scalapay or Satispay).

2 The sales prices, referred to in the previous point, include VAT and any other taxes (except any shipping costs calculated in point 6.3). Shipping costs and any additional charges (e.g. customs clearance), if present, although not included in the purchase price, will be indicated and calculated in the purchase procedure, before the Purchaser forwards the order and will also be contained on the web page summarizing the order placed.

3 The prices indicated for each of the goods offered to the public are valid until the date indicated in the catalogue.

1 City Tre Srl ensures, through the electronic system used, the processing and fulfillment of orders without delay. To this end, it indicates, in real time, in its electronic catalogue, the number of available and unavailable products, as well as shipping times.

2 If an order exceeds the existing quantity in the warehouse, City Tre Srl, via e-mail or telephone contact, will inform the Buyer whether the good can no longer be booked or what the waiting times are to obtain the chosen good, asking whether you intend to confirm the order or not, thus obtaining a refund.

3 The City Tre Srl computer system confirms the registration of the order as soon as possible, sending the user a confirmation by email, pursuant to point 4.2. Failure to confirm the order constitutes the non-conclusion of the purchase contract.

1 City Tre Srl assumes no responsibility for disservices attributable to causes of force majeure, in the event that it is unable to execute the order within the times established by the contract.

2 City Tre Srl cannot be held responsible towards the Buyer, except in the case of willful misconduct or gross negligence, for disservices or malfunctions connected to the use of the internet, outside of its control or that of its sub-suppliers.

3 City Tre Srl will also not be responsible for damages, losses and costs suffered by the Buyer, following failure to execute the contract for reasons not attributable to him, the Buyer having the right only to a full refund of the price paid and any additional charges incurred.

4 City Tre Srl assumes no responsibility for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, upon payment of the purchased products, if it demonstrates having adopted all possible precautions, based on the best science and experience at the time and on the basis of ordinary diligence.

5 Under no circumstances can the Buyer be held responsible for delays or misunderstandings in payment, if he proves that he has made the payment within the times and methods indicated by City Tre Srl

City Tre Srl always wants to guarantee complete customer satisfaction. In addition to the right of withdrawal (art. 15), there is also the right of return. It can be exercised no later than 14 days from the date on which the customer receives the item.

For purchases made on www.citymoda.it it is possible to exchange an item or size at a cost of €5.00.

The costs for returning the item to be returned are free. The customer who intends to return the goods will communicate it by email to info@citymoda.it or by telephone on 080 968530 to proceed with the collection order by the GLS courier. City Tre Srl will refund only the price of the product returned to the same card or current account used at the time of purchase, within 14 working days from the date of receipt of the package. Any extra costs incurred during the purchase phase (cash on delivery or shipping costs and the user's responsibility) will not be refunded. Orders paid on delivery will be refunded via an online voucher (valid for 1 year) or bank transfer. At Citymoda stores, it is possible to make a product exchange by showing the order confirmation received by email at the checkout upon purchase.

In the event of a return, at the checkout, by showing the order confirmation received by email at the time of purchase, it will be possible to deliver the item you wish to return. Important: if you return your items to the store, the data relating to your return will be sent to our e-commerce office where the refund will be processed using the same payment method used during the purchase.

Returns and withdrawals are not possible for purchases made to and from abroad.

1 The Buyer undertakes to pay the price of the purchased good, within the times and in the manner indicated in the Virtual Contract.

2 The Buyer undertakes, once the online purchase procedure has been completed, to print and keep this contract.

3 The information contained in this contract has, moreover, already been viewed and accepted by the Buyer, who acknowledges it, as this step is made mandatory before the purchase confirmation.

1 The obligations assumed by the Buyer, as well as the guarantee of successful completion of the payment that the Buyer makes with the means referred to in the art. 5.2 and also the exact fulfillment of the obligations assumed by City Tre Srl in point 6, are of an essential nature, so that by express agreement, the failure to fulfill just one of these obligations, unless determined by fortuitous circumstances or force majeure, will result in the termination of the contract pursuant to art. 1456 of the civil code, without the need for appeal or judicial ruling.

1 City Tre Srl protects the privacy of its customers and guarantees that the processing of data complies with the provisions of the privacy legislation pursuant to Legislative Decree no. 30 June 2003. 196.

2 The personal and fiscal data acquired directly and/or through third parties by City Tre Srl, data controller, are collected and processed in paper, computer and telematic form, in relation to the processing methods with the purpose of recording the order and activate the procedures for the execution of this contract and the related necessary communications, in addition to the fulfillment of any legal obligations, as well as to allow effective management of commercial relationships to the extent necessary to best carry out the requested service (art. 24, paragraph 1, letter, Legislative Decree no. 196/2003).

3 City Tre Srl undertakes to treat the data and information transmitted by the Buyer with confidentiality and not to reveal them to unauthorized persons, nor to use them for purposes other than those for which they were collected or to transmit them to third parties. Such data may only be exhibited upon request of the judicial authority or other authorities authorized by law.

4 Personal data will be communicated, upon signing of a data confidentiality commitment, only to subjects delegated to carry out the activities necessary for the execution of the stipulated contract and communicated exclusively within the scope of this purpose.

5 The Buyer enjoys the rights referred to in the art. 7 of Legislative Decree 196/03 and, that is, the right to obtain:

14.1 Pursuant to art. 12 of the Legislative Decree. 70/03 City Tre Srl. informs the Buyer that each order sent is stored in digital form on the server or in paper form at the City Tre Srl headquarters, according to confidentiality and security criteria.

1 The Buyer has the right to withdraw from the contract. The withdrawal must necessarily take place no later than 14 days from the date of receipt of the goods described in the stipulated purchase contract.

2 To exercise the right of withdrawal, the Buyer must inform City Tre Srl through an explicit declaration, to be sent to the address info@citymoda.it or to the postal address, with priority mail, present in the epigraph. The return costs are borne by the customer, who must return the purchased items, sending them by courier or post, to the present address: City tre SRL - Via Gino De Sanctis, tag Est 73100 Lecce. Or, the customer can choose to take advantage of the additional on-site collection service of the item to be returned by CityModa, which will collect it via GLS courier on the day and time preferred by the customer: this service has a cost of € 10.00, which will be deducted from the refunded amount.

3 To exercise the right of withdrawal, the date reported and recorded at the time of the declaration will prevail and will be exercisable if the same is drawn up within and no later than 14 days referred to in point 15.1.

4 Withdrawal from this contract entails full reimbursement of the expense (except for any cash on delivery costs and shipping costs). In any case, the refund will take place according to the same method with which the payment was made and only after City Tre Srl has received the return and verified the integrity of the items. For payments by cash on delivery or by bank transfer, refunds require communication of the bank details. Upon explicit request of the customer, City Tre Srl can alternatively issue, instead of a refund, a virtual voucher equal to the cost of the item, valid for one year, which can be spent exclusively on the CityModa online shop. The customer will receive the voucher code in the email indicated at the time of purchase. To use the voucher, you need to copy and paste the code into the relevant field (PROMO CODE) for your next purchase. The voucher can only be used once within 1 year from the time of issue and cannot be combined. Voucher must be used for an order of equal or greater value. The right of withdrawal can be exercised exclusively by the customer and in no case by the recipient of any gift.

5 City Tre Srl reserves the right to suspend the refund until it has received the goods, sent back by the Buyer and in any case will execute the same after verifying their integrity.

6 The customer is responsible for tampering with the goods and any modification of their nature.

7 It is in no way possible to return items purchased online within CityModa stores

8 In any case, returns and withdrawals are not possible for purchases made to and from abroad.

1 Written and direct communications to City Tre Srl and any complaints will be considered valid only if sent to the following address: info@citymoda.it. The Buyer indicates in the registration form his residence or domicile - if they do not coincide, both must be indicated - the telephone number or e-mail address to which he wishes communications from City Tre Srl to be sent

1 All disputes arising from this contract will be referred to the Bari Chamber of Commerce and resolved according to the Conciliation Regulations adopted by it.

2 If the Parties intend to appeal to the ordinary Judicial Authority, the competent court is that of the place of residence or elective domicile of the consumer, mandatory pursuant to art. 33, 2nd paragraph, letter u) of the Legislative Decree. n. 206/2005.

This contract repeals and replaces any agreement, understanding, negotiation, written or oral, that may have previously occurred between the parties and concerning the object of this contract.

1 City Tre Srl declines any responsibility regarding a different perception of the image and colours, depicting the product, due to a malfunction of the screen or that the same, in some cases, may be obsolete, compared to the tools used by City Tre Srl for web content presentations.

2 The images on the site are the property of City Tre Srl

3 Any use of images, without consent from City Tre Srl, may be prosecuted according to the provisions of the law in force.

4 City Tre Srl, regarding web contents, does not guarantee the precision or absence of errors.
